Terms and Conditions of Command Packaging's Invoices
Command Packaging is not liable for any damage to products in the terms covered in this invoice. Any claims involving quantity, quality, or damage shall be made promptly, but not later than 30 days after delivery, and sellers liability shall in no event exceed the purchase price. Product specifications are based on commercially acceptable tolerances. All orders subject to over or under run as stated in published price catalogues or in written quotation.
Returns accepted only with Command Packaging's consent and subject to a shipping and re-stocking charge. Buyer agrees to pay a service charge of a 1/5% per month on all 30 day past due accounts and to pay reasonable attorney's fees and collection costs in addition to any other relief afforded to enforce collection.
This agreement constitutes the entire contract of sale and purchases of the goods and the SELLER shall not be liable for or bound in any manner by any representatives, guarantees or commitments except as specifically provided herein. No modification of this contract shall be of any force or effect unless in writing and signed by the party claimed to be bound thereby, and no modification shall be effected by the acknowledgment of purchase order forms containing different conditions.
